Clear agreements provide a clear atmosphere of communication within the franchise system, because each partner knows what they – in a positive way – can expect from one another. This is especially true regarding the issues:
- trademark protection
- territorial protection
- franchise contract
- franchise fees
The GOLD to go® franchise system is founded on a contractual agreement between the GOLD to go® system central and the GOLD to go® franchisees or area developers, respectively. The GOLD to go® system center provides many up-front features and services for the franchise system, which are being developed as special know-how and are tested and documented.
The GOLD to go® system center provides all this to the GOLD to go® franchisee for the entire term of the GOLD to go® franchise contract. Therefore, it goes without saying, that each GOLD to go® franchise must submit to the contractual safeguarding provisions protecting the entire GOLD to go® franchise system and each individual partner against abuse.
The (international) word-design-mark GOLD to go® is registered in Europe and is therefore protected against improper use by non-entitled parties. The GOLD to go® franchisee or area developer respectively acquires the usage right for the trademark GOLD to go® for the duration of the GOLD to go® franchise contract. They are entitled and obliged to carry the brand GOLD to go® throughout all of their business activities. However, the brand may not become part of their company name.
All GOLD to go® franchisees or area developers, respectively, cooperate on the principle of territorial protection of franchising. This means: the franchisees of the GOLD to go® system act in a “partnership way” and adhere to the musketeer-principle: One for all, and all for one!
As a member of the Deutscher Franchise Verband GOLD to go® has also adopted the European Code of Ethics in franchising, that is based on the fundamental idea, that all people in the system should treat each other fairly and morally. Fairness for the entire system is guaranteed by the commitment of all franchisees and area developers to focussing on their own sales territory and to exploit the regional market.
Territorial protection does not apply to products and services of GOLD to go®, but exclusively to the franchise. The right to territorial protection at GOLD to go® is – just like in many other franchise systems - linked to the obligation of active market cultivation. The basis for the assessment of this active market cultivation is the implementation and fulfillment of the jointly drawn-up marketing and distribution plan, as well as the fulfillment of the agreed minimum turnover.
